National Guard advances
March 7, 2019
The National Guard has already been approved by 13 local congresses, while the states of Sinaloa, Puebla, Guanajuato and Oaxaca are expected to join this configuration.
In order for the reform to be consolidated throughout the Mexican Republic, it must be approved by 17 local congresses, so that it can then reach the Federal Executive Branch, and later be enacted in the Official Gazette. So far, 13 congresses have approved it, among them our state of Nuevo Leon. Martí Batres Guadarrama, President of the Senate of the Republic, informed that this Wednesday, March 6, the discussion of the issue is expected with the congresses of Sinaloa, Puebla, Guanajuato and Oaxaca, in the hope that they will approve this configuration, and thus reach the 17 that were required.
Let us recall that the National Guard in the civilian command eliminated the Joint Chiefs of Staff and eliminated military jurisdiction, leaving the body under civilian jurisdiction. In terms of temporality, it established a 5-year term for the gradual withdrawal of the Army and the Navy to their barracks.
In addition, there will be a program to strengthen state and municipal police forces and an annual evacuation and information program.
In the controls, the Senate must approve an annual report and an evaluation of its elements. The National Guard will act under the police doctrine based on discipline and respect for human rights.
One of the concerns that have arisen during the configuration of the National Guard is where the material resources and the elements that will support its constitution will be obtained.
The Secretary of Public Security, Alfonso Durazo, stated that, in order to improve the Guardia, three new laws must be expanded to regulate its proper functioning.
We are talking about the Organic Law of the National Guard, which will be in charge of delimiting the way in which it will function, as well as its conformation and organization.
The Law on the Use of Force with the objective of delimiting when a security element may or may not use deterrent and lethal weapons, and finally the General Law on the Registration of Detentions which establishes that any person who is detained by this new force or by any other must be brought before the Public Prosecutor's Office.
The corps is expected to be fully operational by the middle of López Obrador's six-year term, in 2021.
